Litigation Case Study: Preventing a Class Action

Young Basile represented The Sherwin-Williams Company, a leading global manufacturer of paints, coatings and related products in a breach of contract case against a former commercial customer in U.S. District Court, Southern District of Florida. In the litigation, Sherwin-Williams sued the business for breaching its contractual obligation to purchase automotive refinishes in excess of $1,000,000 exclusively from Sherwin-Williams. In response, the business asserted a nationwide class action claim for fraud and related allegations. Young Basile attacked the validity of the claims immediately at the initial pleading stage through a motion to strike. Young Basile’s approach successfully thwarted the class action, sparing its client costly and far-reaching class-based discovery.
